GTC

General information
These General Terms and Conditions (GTC) govern the legal framework for the business relationship between SCHLOSSBERG Switzerland AG (hereinafter referred to as SCHLOSSBERG) and the customers of the SCHLOSSBERG online shop.
The GTC are a mandatory component of every contract concluded between SCHLOSSBERG and a customer. The customer confirms that he/she has taken note of the GTC. Additional agreements, assurances or amendments to these GTC must be made in writing.
SCHLOSSBERG may amend the general terms and conditions at any time and without prior notice. The version of these General Terms and Conditions valid at the time of the order is authoritative, which cannot be unilaterally amended for this order. Conflicting or deviating terms and conditions of the customer are not recognised.

Scope of application
In the SCHLOSSBERG online shop, orders can only be placed by private customers (who are at least 18 years old) with a delivery address in Switzerland or Liechtenstein. Deliveries are only made to addresses in Switzerland or Liechtenstein.
Orders in non-household quantities may be rejected without justification.

Offer

The offer and availability in the online shop is aimed at customers (who are at least 18 years old) with a delivery address in Switzerland or Liechtenstein. The presentation of SCHLOSSBERG's offers on the Internet is for information purposes only and is non-binding.

SCHLOSSBERG reserves the right to modify the product range and its presentation at any time and to remove certain products from the range completely. SCHLOSSBERG endeavours to ensure the best possible availability of the products offered on the online shop. The presentation of a product on the webshop does not mean that we can guarantee the availability of the product. SCHLOSSBERG is only obliged to deliver goods in stock or contractually agreed customised goods. If ordered products or parts thereof are not available, SCHLOSSBERG may not be able to fulfil the order in full. In such a case, SCHLOSSBERG will inform the buyer accordingly in good time. Product images produced in the studio, so-called packshots, are displayed in the online shop with the most realistic colour values possible. Nevertheless, it is possible that end devices (desktops, smartphones, tablets) may display them with different colour values.

Staged images with products are taken under the influence of external conditions, for example daylight, and subsequently processed for the best possible colour reproduction. Minor variations in size, colour, structure and finish are reserved. SCHLOSSBERG products are based on natural materials, which may exhibit irregularities. Particularly in the case of repeat/additional orders, deviations are possible without written confirmation to the contrary.

Prices

The prices stated on the website at the time of ordering apply, with the exception of obviously incorrect prices (e.g. 0.00). All prices are gross prices in Swiss francs and include VAT.

The products remain the property of SCHLOSSBERG Switzerland AG until the purchase price has been paid in full. SCHLOSSBERG Switzerland AG is entitled to arrange for entry in the register of retention of title at the buyer's expense if it considers its claim to be jeopardised.

Registration / Privacy policy

It is up to the buyer to register for schlossberg.ch or to place an order without registering. However, certain functions of the website are only available to registered buyers.

When registering, i.e. opening a customer account, the buyer is obliged to provide truthful information about himself/herself. SCHLOSSBERG reserves the right to delete customer accounts at any time and without giving reasons or to block access through a login. The personal password chosen by the customer when registering is not known to SCHLOSSBERG.

The customer is obliged to keep the login data for the customer account strictly confidential and to take appropriate measures to protect their account from unauthorised access, such as the use of a secure password, up-to-date browser versions and anti-virus software etc. The customer is responsible for all actions carried out under this password on the website, even without his knowledge. In particular, the customer is liable for orders placed via their customer account.

Order and conclusion of contract

The presentation of the products in the online shop is not a legally binding application, but a non-binding online catalogue or a non-binding invitation to the customer to order the product in the online shop. All details in the ordering process must be complete and correct.

An order is deemed to be an offer to the online shop to conclude a contract. After submitting the order, the customer automatically receives a confirmation of receipt, which documents that the order has been received by the online shop. This confirmation of receipt does not constitute acceptance. Schlossberg may accept subsequent cancellations of Customer orders at its own discretion and for a fee.

The online shop is free to refuse orders in whole or in part without stating reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded. The contract in the context of an online order in the SCHLOSSBERG online shop is concluded when SCHLOSSBERG has sent the customer the printable order confirmation by e-mail.


Payment options

For payments by credit card or other immediate means of payment, the charge is made when the order is finalised. The prices are binding until the order is confirmed by SCHLOSSBERG or for the period stated in the order confirmation. Payment for the goods is made using one of the means of payment available in the online shop. Payments must be made in Swiss francs.

Prepayment

The online shop may require prepayment. In the case of prepayment, delivery will only be made after receipt of payment. The ordered products are not reserved until payment has been received and may be out of stock in the meantime.

Purchase on account

For customers with residence and delivery address in Switzerland, purchase on account is available up to a maximum order value of CHF 750. As our advance payment is associated with a default risk, we use security mechanisms. The online shop can exclude the payment option purchase on account without giving reasons.

The invoiced amount must be paid to the account specified in the invoice by the due date stated on the invoice form at the latest, without deduction of any discount. In the event of any returns, the invoice amount may be reduced accordingly. Should the customer be in default of payment in whole or in part, SCHLOSSBERG reserves the right to charge reminder fees.

All expenses incurred in connection with the collection of overdue receivables shall be borne by the customer. In the event of unsuccessful reminders, the invoice amounts can be assigned to a company commissioned with debt collection. In this case, an additional effective annual interest rate of up to 15 per cent may be charged from the due date.

Redeeming promotional vouchers

  • Promotional vouchers must have a specifically defined online coupon code in order to be accepted in the online store (e.g. online code: OFFER123)
  • Promotional vouchers are only valid during the specified period and can only be redeemed once as part of an order process. Individual customer groups, customers, product groups, articles or variants of an article may be excluded from the voucher promotion.
  • The value of the goods must be at least equal to the amount of the promotional voucher. For administrative reasons, it is not possible to note or refund any remaining credit.
  • Promotional vouchers can only be redeemed before completing the order process. Subsequent offsetting is not possible. The credit balance of a promotional voucher is neither paid out in cash nor does it bear interest.
  • The promotional voucher cannot be transferred to third parties. Several promotional vouchers cannot be combined with each other.
  • If the balance of a promotional voucher is not sufficient for the order, the difference can be settled using the payment options offered.
  • The promotional voucher will not be refunded if goods are returned in whole or in part, provided that the promotional voucher was issued as part of a promotion and no consideration (financial) was provided in return.

Schlossberg gift card

  • The Schlossberg gift card can be ordered and redeemed in all Swiss Schlossberg boutiques and in the online store at www.schlossberg.ch (physically or as a Print@home version).
  • The card balance can be checked at any checkout in Schlossberg boutiques and via the QR code on the back without the need for a customer account.
  • The gift card can be topped up in the Schlossberg boutiques.
  • The remaining amount will be kept on the card and cannot be paid out in cash, exchanged for vouchers or credited to a credit card.
  • The card will not be replaced in the event of loss or theft.
  • The gift card purchased in the online store will be sent by post. You will receive the virtual gift card (Print@Home) as a PDF by e-mail immediately after ordering in the online store.


Delivery

Deliveries are only made to addresses in Switzerland or Liechtenstein. The delivery of ordered items with a purchase value of CHF 150 or more is free of charge for customers with a delivery location in Switzerland and Liechtenstein.

The packaging and shipping costs are displayed in detail before the order is completed and shown separately on the invoice. SCHLOSSBERG is not liable for undeliverable or delayed delivery of the goods due to incorrect delivery address information by the customer or absence of the recipient.

SCHLOSSBERG offers the products subject to availability. If a product is not or no longer available, the customer will be informed accordingly. SCHLOSSBERG reserves the right to withdraw from the contract if products are no longer available through no fault of SCHLOSSBERG.

The delivery period for available goods is 2-3 working days from receipt of the order. SCHLOSSBERG is not liable for delays in delivery through no fault of its own, e.g. due to force majeure, traffic jams, strikes, bad weather conditions, etc., and they do not entitle the customer to withdraw from the purchase contract or to claim damages.

Longer parcel delivery times must be expected before public holidays (Easter, Christmas).

Unless expressly agreed otherwise, benefit and risk are transferred to the customer when the goods are made available for dispatch by SCHLOSSBERG. SCHLOSSBERG is not liable for the proper fulfillment of deliveries made by third parties (e.g. external logistics service providers, shipping companies, Swiss Post). In particular, SCHLOSSBERG accepts no responsibility for delays, damage or loss of goods caused by third parties during transportation.

The customer is obliged to assert any claims in connection with the delivery directly against the respective transportation service provider. SCHLOSSBERG is not responsible for the processing of such claims.

The customer undertakes to check the goods immediately upon receipt for completeness and condition. Any complaints regarding quality and completeness must be reported to SCHLOSSBERG immediately, but at the latest within 48 hours of delivery, otherwise the delivery is deemed to have been accepted, unless it concerns defects that were not recognizable during the initial inspection. If such defects are discovered later, notification must be made immediately after discovery, otherwise the goods are deemed to have been accepted.


Warranty

Defective products will be repaired by SCHLOSSBERG, replaced by the same or a similar article or the purchase price paid will be refunded (conversion). In the case of minor defects SCHLOSSBERG can also propose a price reduction. If SCHLOSSBERG decides to repair or replace the goods, the customer's claims for rescission of the purchase contract or reduction of the purchase price as well as for damages are excluded.

SCHLOSSBERG is not liable for defects which the customer recognized or should have recognized upon receipt and did not report immediately after discovery and within the warranty period.

The warranty expires two years after purchase. The warranty shall not apply if the customer modifies the product himself/herself or has it modified by a third party and cannot prove that the defects complained of were not caused in whole or in part by such modifications. The warranty is also void if the customer does not use the product properly.

Deviations in color representations may depend on the monitor used and the recording technology and do not constitute a defect.

SCHLOSSBERG accepts returns via a service provider or returns to a Schlossberg boutique.


Returns are registered via Register return. For further information on tVhe procedure for returns, please refer to the information contained on Shipping & Returns. 

The costs for a return shipment are generally borne by the customer.

Refunds for justified returns will be processed within 30 days using the same means of payment that the customer used to place the order. A detailed description of returns can be found under Shipping & Returns.


Right of withdrawal

SCHLOSSBERG grants the right to return the ordered goods without giving reasons under the conditions listed in the right of withdrawal section.

Liability

SCHLOSSBERG is only liable for damages caused by intentional or grossly negligent behavior. Liability for indirect damages, consequential damages or loss of profit is excluded.

Applicable law / place of jurisdiction

These General Terms and Conditions are governed by Swiss substantive law (to the exclusion of the UN Convention on Contracts for the International Sale of Goods, the Hague Convention on the Law Applicable to International Sales Contracts for Movable and Tangible Goods and the conflict of laws rules of the IPRG). The place of jurisdiction for actions brought by consumers shall be their place of residence or Zurich. In all other cases, Zurich is the exclusive place of jurisdiction.
